Due to our complex shipping requirements, shipping
is NOT always accurate and may add additional costs to your final order
before shipping (you will be informed prior). We will ship your order
using the best means available for the products that you order. We also
strive to ship at the most cost-effective means for you. If you require
a quote for shipping costs, please check the appropriate box on the mail/fax
order
form. It may delay your order, however. You will receive an estimate
for shipping by e-mail, so please make sure that your e-mail address is
entered carefully and correctly.
We do drop-ship some items from our partner outlets, we do not hold a
large inventory we do this to keep over heads down so we can pass on the
savings to you.

Product
Availability
For the most part all products will be available through our distributors
and shipped with-in three business days. If for some reason a product
is not available or on back ordered you will be contacted and given the
option to have that item removed from your order. All other items on your
order will be shipped. Any item sent as a back order will be sent at no
additional shipping cost.

Minimum Order
We don’t require any minimums on your retail order. You’re
free to order whatever you need, even if it’s one small item. !!!

Payment
All prices shown are in US dollars. Orders are required to be paid in
advance by any method mentioned in acceptable payment. Shipment will immediately
follow clearance of your payment. If you would like to open an account,
you will need to send in a credit application and allow at least three
weeks for processing (NOT CURRENTLY AVAILABLE). (This applies to domestic
orders only.) You may request this application form from the accounting
department. Schools, government agencies and institutions purchase orders
(U.S. only) will be accepted on net 30-day terms. Faxed or mailed copies
of the purchase orders are required for our records and usually for your
accounting department's records. No sales tax except for Florida destinations
(6.5 %). For shipments to Florida destinations, a signed Florida resale
certificate must be on file prior to shipping, otherwise you will be charged
Florida sales tax.
Creature Brands, Inc. reserves the right to cancel the sale of incorrectly
priced items.

Terms of
Payment
Except as otherwise stated in any attachment, terms are net due upon purchase.
Payment method will be credit card (Visa, MasterCard). Checks are accepted
subject to collection and the date of collection shall be deemed the date
of payment is cleared through the bank. Any check received from Buyer
may be applied by Seller against any obligation owing from Buyer to Seller,
regardless of any statement appearing on or referring to such check, without
discharging Buyer's liability for any additional amounts owing from Buyer
to Seller, and the acceptance by Seller of such check shall not constitute
a waiver of Seller's right to pursue the collection of any remaining balance.
Buyer shall pay interest on any invoice not paid when due from the due
date to the date of payment at the rate of one and one-half (1-1/2%) percent
per month or such lower rate as may be the maximum allowable by law. If
buyer fails to make payment when due, Seller may pursue any legal or equitable
remedies, in which event Seller shall be entitled to reimbursement for
costs of collection and reasonable attorneys fees. There shall be no time
limit as to when Seller shall pursue any legal or equitable remedies.
Reasonable annual costs of collection and attorney fees shall be defined
as the greater of a maximum of $50,000, one hundred percent (100%) of
compounded collection amount, or maximum allowable by law.

Taxes
Purchaser shall pay all federal, state, municipal or other sales, use,
excise or other taxes, assessments
and charges assessed or levied against the products
and/or services. Purchaser agrees to pay to
Creature Brands, Inc. on request any federal, state,
municipal or other sales, use, excise or other
taxes, assessments or charges payable by Creature
Brands, Inc. with respect to the products and/or services
of the sale thereof.

Address
United Parcel Service (UPS), Federal Express (Fed Ex) and motor freight
will not deliver to a Post Office Box
so it is necessary that you give us your street address
for all orders other than U.S. mail or parcel post.

Size and
Weight
UPS will not deliver individual boxes heavier than 150 pounds. Boxes more
than 150 pounds and/or oversized for UPS, will be shipped via motor freight
collect (collects the freight charge at the time of delivery). If you
cannot accept freight collect shipments, we will ship freight prepaid
for a handling fee of 10 percent of the freight cost. Some items will
be shipped oversized / exposed (no box). These items will incur an additional
shipping charge.

Hazardous
Material
The U.S. Department of Transportation (D.O.T) requires special shipping
or packaging for some products. Products that may be toxic, corrosive
or highly flammable may require additional charges per package. We have
identified these products for you throughout the catalog. Please download
and fax our Chemical
Purchase Form prior to placing an order for F.D.A. controlled chemicals
sold within our catalog. We will be happy to assist you in choosing the
best shipping methods for your situation.

International
Orders (not currently available)
NOTE: Due to an increase in International Mail Order Fraud, we have suspended
the shipments of all merchandise outside of the U.S. and Canada. Our apologies.

Returns
Policy
Your satisfaction is our goal. We honor our guarantees and our return
policies are fair. Please refer to our homepage under the section "30-Day
No Hassle Returns" for the appropriate documentation. (Some items
are excluded from this return policy). We do not accept C.O.D. returns.
Please check your orders immediately upon delivery. We do not refund packing,
shipping or handling fees. Undamaged items may be returned. If we send
you something by mistake we will reimburse you for shipping. A 20 percent
minimum (depending on condition) restocking fee will be charged after
30 days.
If your merchandise arrives damaged, please contact us within 24 hours
of delivery. All damage claims must be filed with the
carrier. We will provide you full assistance in the unlikely event. You
must call for a return merchandise form prior to returning damaged merchandise.
Items returned without an return merchandise form will be refused and
returned to sender.
Returns must:
- Be in original packaging which includes all internal
packing
- Be in original box, undamaged and unmarked. Packages
returned with postage stickers on display box cannot be refunded. If
you ship an item back in its original display box, a restocking fee
will be assessed and in some cases we may not be able to accept the
return. Please take care of the display box.
- Include all accessories, paperwork, instructions
and warranty cards.
- Be resalable as new merchandise.
- When packaging merchandise for return, please
provide adequate protection to ensure all pieces arrive in new, resalable
condition. We are not responsible for damage in transit due to poor
or inadequate packaging.
If you cannot meet these conditions, we may impose
a restocking fee up to 20% of the cost of the product. For obvious reasons,
orders that have been shipped but not yet received by you cannot be cancelled.
You can, however, return them within the terms of this document once you
receive the merchandise. Any item displaying an expiration date and custom
jobs are non refundable or exchangeable unless damaged in transit. We
can provide you with a rough time frame when placing your order. When
requesting express service, such as UPS Overnight, 2nd Day Air, 3-Day
Select, USPS Overnight or Air Cargo Express, we will provide you with
confirmation on your sales receipt. In the unlikely event that your chosen
carrier delays your order, we will provide you assistance in filing a
claim. We will ship via any expedited UPS / Airborne Air Service at your
request. However, we do this as a convenience to you; if merchandise is
damaged in shipping or is in non-working order upon reception, we will
replace the product free of charge including ground shipping. If you'd
like us to reship merchandise using an Air Service, we will be happy to
credit the ground service costs towards any shipping method.
We do our very best to see that express shipments received and shipped
the same day. However, we cannot do this in every case and cannot make
any guarantees.

Order
Cancellation Policy
Orders cannot be cancelled or refused after the orders have been shipped.
Refused orders are subject to an automatic 25% restocking fee plus return
freight charge. Orders cannot be cancelled or refused due to delay in
shipping or order processing.

Quotations
If you require a large quantity of any item or if you have OEM applications,
ask us for a special price quotation. We also welcome the opportunity
to bid institutional purchases.

Warranties
Your Warranty
Creature Brands, Inc., sells products made by many manufacturers, most
of whom have written warranties of various lengths. These warranties are
included in the packaging.
Several of our major manufacturers’ policies
require that you contact them directly for assistance regarding their
products. Furthermore, some of our major manufacturers have a staff trained
specifically to service their product line. These manufacturers will support,
repair, return or replace them in accordance with their own policies:
Creature Brands, Inc. only distributes products from
manufacturers who provide at least average customer service. If you have
found a manufacturer's service less than satisfactory, please inform us
at Customersupport@Creaturebrands.com. We take these complaints very seriously.
Regrettably, we have discontinued distribution for many manufacturers
who are unable to provide at least average levels of customer service.
This is done in the interest of our customers.
CREATURE BRANDS, INC. WILL NOT BE RESPONSIBLE OR
LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, however arising,
including but not limited to those for use of any products, loss of time,
inconvenience, lost profit, labor charges, or other incidental or consequential
damages with respect to persons, animals, business, or property, whether
as a result of breach of warranty, negligence or otherwise. Notwithstanding
any other provision of this warranty, BUYER'S REMEDY AGAINST CREATURE
BRANDS, INC. FOR GOODS SUPPLIED OR FOR NON-DELIVERED GOODS OR FAILURE
TO FURNISH GOODS, WHETHER OR NOT BASED ON NEGLIGENCE, STRICT LIABILITY
OR BREACH OF EXPRESS OR IMPLIED WARRANTY IS LIMITED SOLELY, AT THE OPTION
OF CREATURE BRANDS, INC. , TO REPLACEMENT OF OR CURE OF SUCH NONCONFORMING
OR NON-DELIVERED GOODS OR RETURN OF THE PURCHASE PRICE FOR SUCH GOODS
AND, IN NO EVENT, SHALL EXCEED THE PRICE OR CHARGE FOR SUCH GOODS. CREATURE
BRANDS, INC. EXPRESSLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR FITNESS
FOR A PARTICULAR USE OR PURPOSE WITH RESPECT TO THE GOODS SOLD. THERE
ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTIONS SET FORTH IN THIS
WARRANTY, not withstanding any knowledge of CREATURE BRANDS, INC. regarding
the use or uses intended to be made of goods, proposed changes or additions
to goods, or any assistance or suggestions that may have been made by
Creature Brands personnel.
Unauthorized extensions of warranties by the customer
shall remain the customer's responsibility.
CUSTOMER IS RESPONSIBLE FOR DETERMINING THE SUITABILITY
OF CREATURE BRANDS PRODUCTS FOR CUSTOMER'S USE OR RESALE, OR FOR INCORPORATING
THEM INTO OBJECTS OR APPLICATIONS WHICH CUSTOMER DESIGNS, ASSEMBLES, CONSTRUCTS
OR MANUFACTURES.
Only Creature Brands, Inc. personnel can modify this
warranty by signing a specific, written description of any modifications.
